Henry Fenton and James Curcio recently earned a jury trial victory against The Regents of the University of California in a case tried before the Superior Court of California for the County of Los Angeles.
In the case, Fenton Jurkowitz Law Group represented a doctor who had been terminated due to an alleged failure to report to UCLA a physician’s sexual misconduct at a clinic within the University’s network – a purported violation of the University’s Sexual Violence and Sexual Harassment Policy. Defendant also maintained that the plaintiff violated another faculty policy by failing to personally ensure that the offending physician was prohibited from certain patient contacts during examinations.
Over the course of the trial, Henry and Jim successfully argued that the plaintiff met the reporting requirements outlined under both policies, and the doctor’s termination was resultingly deemed wrongful in a Notice of Entry of Judgment filed on May 31, 2023.
