Henry Fenton and Fenton Jurkowitz Law Group represented three prominent head and neck surgeons accused of unethical conduct stemming from their expert testimony in court pertaining to the causes of head and neck cancer. The allegations were made against the physicians to the American College of Surgeons, the certifying body for physician board certification in surgery in the United States. Further, allegations were made to the same effect against one of the three physicians to the American Academy of Otolaryngology-Head and Neck Surgery.
The American Academy of Otolaryngology, after considering the allegations and evidence, dismissed the charges and determined that they could not be refiled. The Evaluation Panel of the American Academy of Otolaryngology-Head and Neck Surgery concluded that no prima facie evidence was presented to substantiate that the physician violated any aspect of the ‘”AAO-HNS Guidelines for Behavior of the Physician Expert Witness.” The same action, dismissing the charges, was taken by the American College of Surgeons with respect to one of the accused physicians. Finally, in a decision rendered in June 2016, after a hearing, the American College of Surgeons, ruled in favor of the two remaining physicians and closed the cases.
