Nick Jurkowitz successfully defended an occupational therapist against an Accusation brought by the Occupational Therapy Board (“The Board”), which sought to take away the therapist’s license for failing to renew it on time and allowing the license to lapse for approximately 9 months. In addition, The Board sought discipline alleging that the therapist was incompetent for failing to renew her license. After a full trial, the judge issued the lowest form of discipline: a public letter of reprimand, and most importantly, ruled that the therapist was not incompetent, thus allowing the therapist to keep her license.
