Ben Fenton recently published an article in the Los Angeles and San Francisco Daily Journal examining the Supreme Court’s decision in American Hospital Association v. Becerra, a case in which several hospital groups sued the Department of Health and Human Services (HHS) on the grounds that HHS violated the Medicare Prescription Drugs, Improvement, and Modernization Act of 2003. The court ruled in favor of the hospital groups in a unanimous decision handed down by Justice Kavanaugh on June 15, 2022.
“It is not surprising that the Court’s decision was unanimous,” Ben shares in the article. He highlights a recent rule change made by HHS that “clearly violated the detailed provisions in the Act related to calculating reimbursement rates,” and notes that “only time will tell whether HHS will go to congress to seek a change to the Act.”
